Answer. Upon receipt of a grievance, as a result of a failure Any grievance not answered within the specified time limit may be immediately taken to meet time limits by the agency, OCB shall schedule a meeting with the Staff representative and a Chapter representative within thirty (30) days of receipt next higher step of the grievance appeal procedure. A grievance is defined as any difference concerning the interpretation or application of any of the terms of this agreement. Grievances shall be settled in an attempt to resolve the following manner.
Step 1 Any employee who believes they have a grievance unless the parties mutually agree otherwise. Within thirty-shall discuss it with their supervisor and if not resolved shall, within five (355) days of the OCB meetingemployee’s scheduled working days after the event giving rise to the grievance, OCB shall provide present a written response which may grant, modify or deny grievance indicating the remedy being sought by the Union. The response will include the rationale facts upon which the decision grievance is rendered based, the article of the contract allegedly violated, and will the remedy sought, and discuss it with his or her supervisor, at which time a Union representative of the employee, if the employee desires, shall be forwarded present and they shall make an effort to settle such grievance. The supervisor shall give his or her answer within five (5) working days after receiving such grievance. Settlements made in this step of the grievance procedure shall have no precedent value.
Step 2 In the event such grievance is not settled, it shall be presented in writing by the employee and/or his or her Union representative within five (5) working days thereafter to the grievantCompany. Cases involving discharge shall be presented initially in writing at the third step of the grievance procedure, no more than five (5) working days from the Union's date of discharge.

1. Any grievance which remains unsettled after having been fully processed pursuant to the Grievance Procedure may be taken to arbitration, by request of either party, within ten (10) days after the Step 3 answer has been rendered.
2. The Arbitrator shall not have the authority to add to, disregard, or to modify any of the terms of this Agreement, including salary rates, benefits plans, or job classifications. Additionally, the Arbitrator shall not have the authority to review, revoke, modify, or enter any award with respect to the discharge of an employee within their probationary period as specified in Article 6.
3. Within ten (10) days after either party notifies the other of its desire for arbitration, as provided herein, either party may request the Federal Mediation and Conciliation Service, or its successor, in writing, to submit a list of not less than five (5) arbitrators from which the Union and the Company shall strike off the names on the list who are not acceptable and shall indicate the order of preference of those remaining. In the event all names are stricken from the list, the Union and the Company shall, within ten (10) days of such action, request the Federal Mediation and Conciliation Service, or its successor, to submit a second list of not less than five (5) arbitrators and the above procedure for selecting this panel shall be the same as set forth followed.
4. All time limits noted in Section 25.04 for the selection this article are exclusive of arbitratorsFridays, Saturdays, Sundays, and site closure days. No mediator/arbitrator shall hear a case at both mediation and arbitration. The fees and expenses They can be extended by mutual agreement of the mediator parties.
