Any Termination for Breach. In the event of termination of this Agreement by a Party for the other Party’s uncured material breach, such termination shall not affect the terminating Party’s right to claim damages against the breaching Party for such breach. In the event the non-breaching Party waives its right under Section 13.2 or Section 13.3 to terminate, such non-breaching Party shall not be prevented from seeking damages for a material breach by the breaching Party during the term of this Agreement.
