Applicability of This Article III to Business Associate. If under the Service Agreement, Business Associate is performing any Electronic Transactions on Behalf of Gateway, then all of the provisions of this Article III are applicable to Business Associate and Business Associate hereby agrees to comply with all of the provisions of this Article III. If the Services being performed by Business Associate under the Service Agreement do not involve the performance by Business Associate of any Electronic Transactions on Behalf of Gateway, then this Article III is not applicable to Business Associate and the parties agree that this Article III is hereby deleted from this Exhibit 2. As used herein, the term “Electronic Transactions on Behalf of Gateway” means any or all of the following electronic transactions performed by Business Associate under the Service Agreement on behalf of Gateway:
