APPLICATION OF THESE TERMS AND CONDITIONS. 2.1 Subject to any variation under Clause 26, the terms of the Order shall prevail at all times over all other terms and conditions which the Supplier may purport to apply and to the extent any obligations hereunder have already been performed by either party, then such obligations shall for all purposes be subject to the provisions of the terms of the Order. 2.2 Each Order shall be deemed to be an offer by Sport England to buy the Goods and/or Services subject to these Terms and Conditions. Each Order shall be accepted once the Supplier either expressly, by giving notice of acceptance, or impliedly, by fulfilling the Order in whole or in part, accepts the offer. The Supplier undertakes to deliver the Goods and/or Services in accordance with the Contract. The Supplier shall notify Sport England immediately if it becomes aware of any likely delay in providing the Goods and/or Services.
