Common use of Appointment of Arbitrator Clause in Contracts

Appointment of Arbitrator. a. An impartial arbitrator shall be selected jointly by the parties from a list of nine (9) arbitrators provided by the State of California Mediation and Conciliation Service. b. After receipt of the list, the parties shall alternately strike arbitrator’s names from the list until one (1) arbitrator’s name remains. c. If an arbitrator selected declines appointment or is otherwise unavailable, a new list shall be requested as per Subsection a. above, unless an arbitrator can be mutually agreed upon.

In the event the parties are unable to agree, the parties shall solicit from a list of nine (9) arbitrators provided by the State of California Mediation and Conciliation Service. b. Service a list of seven (7) arbitrators. After receipt of the list, the parties shall alternately strike an arbitrator’s names name from the list until one (1) arbitrator’s name remains. If the selected arbitrator is unable or unwilling to hear the grievance within the time prescribed by Section 16.14, the parties shall again repeat the process unless they can mutually agree upon an arbitrator. c. If an arbitrator selected declines appointment or is otherwise unavailable, a new list shall be requested as per Subsection a. above, unless an arbitrator can be mutually agreed upon.
