Appointment; Provision of Services. Conditioned on the provisions in this Section 2 and the other terms and conditions of this Agreement and payment of the applicable Fees, InterPayments hereby appoints Partner, and Partner hereby accepts, for the Term (unless terminated as provided in this Agreement), a nonexclusive, non-transferable, appointment for the Territory to act as an InterPayments approved Partner of the Services for the Territory. Partner shall market, promote and re-sell the Services to Customers and potential Customers in the Territory, at its own expense and using its own efforts with its own sales force (including Partner Agents).

  • Provision of Services (a) The HSP will provide the Services in accordance with, and otherwise comply with:
