Arbitration Hearing and Costs. The arbitrator shall schedule and conduct the hearing in accordance with the Voluntary Rules of the American Arbitration Association. Each party shall be responsible for the costs of presenting its case. With the exception of fees charged for postponement, unilateral withdrawal, or cancellation, which shall be borne by the party initiating such action, the fees and expenses of the arbitrator shall be allocated by the arbitrator as follows: 1. Assign the arbitrator’s fees and expenses to the losing party. 2. If the arbitrator determines that neither party is the losing party, then the arbitrator shall assign the arbitrator’s fees and expenses proportionally to the parties as judged to be equitable.
