Common use of Arbitration Location Clause in Contracts

Arbitration Location. Any arbitration initiated by a written demand of PBM shall be conducted in San Diego, California, or such other place in the United States as shall be agreeable to NANOGEN in its sole discretion. Any arbitration initiated by the written demand of NANOGEN shall be conducted in Xxxxxx County, New Jersey USA, or such other place in the United States as shall be agreeable to PBM in its sole discretion. The Parties consent to the personal jurisdiction of the courts in each such location for any cause arising out of or otherwise related to this arbitration, its conduct and its enforcement.
