As Designed. It is Xxxxxx’s intention that no change orders or other requests by Purchaser for changes to the Plans and Specifications will be accepted by Seller. Purchaser understands and agrees that Purchaser is accepting the Unit as designed, subject to reserved rights by Seller in this Agreement to modify certain elements of the Unit and the Project. Seller is under no obligation whatsoever to accept or evaluate requests from Purchaser for custom changes or upgrades to the Unit and Seller may deny any such request for any reason or no reason. Purchaser shall not contract for any work on the Unit, and Xxxxxxxxx agrees that no work will be permitted on or in the Unit by anyone other than Seller until Closing.

  • The Design Builder shall indemnify the Owner for the cost and expense the Owner incurs (1) for remediation of a material or substance the Design-Builder brings to the site and negligently handles, or (2) where the Design-Builder fails to perform its obligations under Section 10.3.1, except to the extent that the cost and expense are due to the Owner’s fault or negligence.

  • No Process or Design Changes Supplier shall not make any process or design changes affecting Products or Services without DXC’s prior written consent.

  • Filing Designation The City Department Director will designate each individual who will be providing services to the City pursuant to the Agreement as full disclosure, limited disclosure, or excluded from disclosure, based on an analysis of the services the Consultant will provide.   • If Designated If the HSP is Designated it will:

  • Unbundled Copper Loop – Non-Designed (UCL-ND 2.4.3.1 The UCL–ND is provisioned as a dedicated 2-wire metallic transmission facility from BellSouth’s Main Distribution Frame (MDF) to a customer’s premises (including the NID). The UCL-ND will be a “dry copper” facility in that it will not have any intervening equipment such as load coils, repeaters, or digital access main lines (DAMLs), and may have up to 6,000 feet of bridged tap between the End User’s premises and the serving wire center. The UCL-ND typically will be 1300 Ohms resistance and in most cases will not exceed 18,000 feet in length, although the UCL-ND will not have a specific length limitation. For Loops less than 18,000 feet and with less than 1300 Ohms resistance, the Loop will provide a voice grade transmission channel suitable for Loop start signaling and the transport of analog voice grade signals. The UCL-ND will not be designed and will not be provisioned with either a DLR or a test point.
