Assurance of Performance. If Contractor: A. Is the subject of any labor unrest from its own employees, including work stoppage or slowdown, sickout, picketing or other concerted job action; B. Appears in the reasonable judgment of County to be unable to regularly pay its bills as they become due; C. Is the subject of a civil or criminal proceeding brought by a federal, State, regional or local County for violation of an environmental law in the performance of this agreement, the result of which is reasonably likely to materially impede Contractor’s ability to perform its obligations under this agreement, or D. Performs in a manner that causes County to be uncertain about Contractor's ability and intention to comply with this agreement, County may, at its option and in addition to all other remedies it may have, demand from Contractor reasonable assurances of timely and proper performance of this agreement, in such form and substance as County may reasonably require.
