(b) During the Term, and subject to availability and to the rules and other policies that apply to staff of the University, each employee of UTS shall be entitled to use the athletic facilities at the University’s St. ▇▇▇▇▇▇ campus, provided that she or he is a member of the Joint Membership Plan.

The University shall permit MBCS to use the following athletic facilities on an as- available basis: Outdoor natural turf and artificial turf playing fields for special events (MBCS Field Day and similar uses) at a cost consistent with CSUMB’s rate structure for use determined by use of the standard Exhibit C Conference and Events Services Room and Service Fees, recognizing that MBCS is a 501(c)(3) not-for-profit institution. MBCS must schedule access to these facilities by contacting the offices of the Athletic Director a minimum of 30 days in advance.. Access to these facilities shall be limited to currently enrolled MBCS students, faculty and staff, and parents and invited guests. MBCS will provide its own staffing and equipment for such events. MBCS shall provide on-site supervision at all times during use of the athletic facilities. MBCS administrators, faculty and staff shall enforce University rules and policy on the appropriate use of the facilities and shall ensure that the MBCS students abide by those rules, including but not limited to, wearing appropriate footwear and safety equipment.
