Authority of the Department. Except as expressly prohibited by Maryland law, any of the State’s rights, powers or duties under this Contract may be exercised or enforced by any officials or employees of the Department who are authorized to do so by the Secretary of Public Safety and Correctional Services. Where this Contract provides for the exercise or enforcement of rights, powers or duties by a specific official or employee of the Department, the Department may unilaterally, and within its sole discretion, change the designated official or employee upon written notice to the Contractor. To the extent that the Department utilizes internal review or approval processes in making determinations under this Contract, the Contractor has no right to or in connection with those processes.

Authority of the Department. The Department retains the authority to exercise discretion in the administration and supervision of all Waiver-related matters including the terms and conditions of this Agreement and to issue Departmental Decisions and Written Policies and Procedures related to the Waivers. An AE does not have the authority to change or disapprove any administrative Departmental Decisions or otherwise substitute its judgment for that of the Department with respect to the application and implementation of Written Policies and Procedures and Departmental Decisions.

The Department may at its discretion, authorize the AE to act as the Department’s designee for matters relating to the implementation of and the provision of technical assistance regarding state or federal regulations that establish program, operational, and/or payment requirements to providers as defined herein.

  • RESPONSIBILITIES OF THE DEPARTMENT The Department agrees to:

  • Monitoring by the Department The Contractor shall permit all persons who are duly authorized by the Department to inspect and copy any records, papers, documents, facilities, goods, and services of the Contractor that are relevant to this Contract, and to interview clients, employees, and sub-contractor employees of the Contractor to assure the Department of satisfactory performance of the terms and conditions of this Contract. Following such review, the Department shall deliver to the Contractor a written report of its finding, and may direct the development, by the Contractor, of a corrective action plan. This provision shall not limit the Department’s termination rights.

  • Environmental Protection Except as set forth in Schedule 5.13 annexed hereto:

  • Department of State Registration Consistent with Title XXXVI, F.S., the Contractor and any subcontractors that assert status, other than a sole proprietor, must provide the Department with conclusive evidence of a certificate of status, not subject to qualification, if a Florida business entity, or of a certificate of authorization if a foreign business entity.
