Automatic Escalator. The limits of liability for each policy coverage amount stated above shall be automatically adjusted upward as necessary to remain at all times not less than the maximum amount of liability set forth in Chapter 537.610 RSMo. applicable to political subdivisions pursuant to 537.600; provided that nothing herein or in any such policy shall be deemed to waive the City’s sovereign immunity. The statutory waiver of sovereign immunity for 2020 is $2,905,664 for all claims arising out of a single accident or occurrence.

Automatic Escalator. Notwithstanding the fee revisions outlined in the Fee Schedules paragraph above, fees included herein which are established under the terms of the underlying Quote / Order Confirmation / Statement of Work (e.g., staffing fees, software licensure fees, etc.) shall be subject to a fee escalator equal to the greater of 5% or the greatest positive change (if any) in the CPI‐U during the preceding year for the San Francisco Bay Area as determined by the Bureau of Labor Statistics. The escalator shall not apply during the first year of this Agreement but shall apply to subsequent years and any renewals.

Automatic Escalator. It is anticipated in this contract that the prosecution of the design work shall proceed upon signature of the agreement and be generally accomplished on an uninterrupted time schedule, unless otherwise noted in the miscellaneous conditions. In the event that work is delayed for any reason beyond the Golf Course Designer’s control, all phases of the work as described in Article 2 will be subject to an automatic escalator equivalent to the consumer price index if any of the phases have not been initiated within six (6) months of the date of acceptance of this agreement. Reimbursable expense estimates, hourly rates, consultants charges and other miscellaneous charges (if applicable) are also subject to increases in exactly the same proportion as allocated to professional fees, as described above.

  • Automatic Renewal Limitation for TIPS Sales No TIPS Sale may incorporate an automatic renewal clause that exceeds month to month terms with which the TIPS Member must comply. All renewal terms incorporated into a TIPS Sale Supplemental Agreement shall only be valid and enforceable when Vendor received written confirmation of acceptance of the renewal term from the TIPS Member for the specific renewal term. The purpose of this clause is to avoid a TIPS Member inadvertently renewing an Agreement during a period in which the governing body of the TIPS Member has not properly appropriated and budgeted the funds to satisfy the Agreement renewal. Any TIPS Sale Supplemental Agreement containing an “Automatic Renewal” clause that conflicts with these terms is rendered void and unenforceable.

  • INTERIM MAINTENANCE PERIOD During the interim maintenance period between obtaining of the completion certificate of Project and formation and operationalization of the Association the Promoter shall through itself or through a facility management company constitute a committee to run, operate, manage and maintain the Common Areas.

  • Automatic Termination This Agreement shall automatically and immediately terminate in the event of its “assignment” (as defined in the 1940 Act).

  • Automatic Payments You can agree with a seller who accepts PayPal to use PayPal as the payment method for future purchases with that seller. This agreement is between you and the seller and allows you to pay the seller on a one-time, regular or sporadic basis. Depending on the seller you wish to pay, you might also be able to directly instruct PayPal to make future payments to the seller on your behalf on a one-time, regular or sporadic basis. If you have authorised an automatic payment and PayPal performs currency conversion for an automatic payment transaction, PayPal will use the transaction exchange rate (including PayPal's currency conversion fee) in effect at the time the automatic payment transaction is processed.
