Common use of Automatic Leave of Absence Clause in Contracts

Automatic Leave of Absence. After exhausting all sick leave, excess sick leave, and Sick Leave Bank, personnel will automatically be placed on leave of absence without pay. When an employee is placed on an automatic leave of absence, a statement from a doctor indicating that the employee is unable to work must be furnished for the leave to remain in effect. An employee returning from an automatic leave of absence must present a doctor's statement indicating that he/she is able to return to work without restrictions. While an employee is on leave of absence without pay, benefits or experience will not accrue, but the employee will not lose prior experience or benefits and will be eligible to participate in professional associations. Although the leave of absence will not be considered as a break in employment, salary increments based on additional experience will not be granted for the period of the leave of absence except when the teacher has completed at least one-half year of service before being placed on automatic leave of absence. Automatic leave of absence shall not exceed one contract year. Exceptions may be allowed for individual cases when a request is submitted to the designee of the Board and approved by the Board.
