Availability and Eligibility. 3.1. The Product is available since January 5, 2022 and shall continue to be available until further notice issued by XXXXXXXX. 3.2. In lieu with Clause 3.1, any extension or discontinuation of the Product shall be at sole discretion of XXXXXXXX. 3.3. The Product shall be only eligible for the Receiving Parties who can be anyone above legal age of 18 and who is financially capable of performing any Payment of the selected Product’s services. 3.4. In lieu with Clause 3.3, The Product shall be eligible for both existing and new XXXXXXXX Customers. 3.5. The Receiving Parties acknowledged, agreed, and declared that the motive of using the Product and the Receiving Parties themselves both are not and shall not be involved in any activities deemed illegal in one or more countries notably The Receiving Parties’ and XXXXXXXX’x country of operations such as but not limited to Malaysia, Singapore, Japan, United States, China, European Union members, and United Kingdom. 3.6. Notwithstanding the aforementioned, XXXXXXXX reserves the right at its sole discretion to include any other Customers or Vendors who XXXXXXXX deems fit for the fulfillment of the purchased Services. 3.7. The Receiving Parties will continue to enjoy the outcome of the Product and the Product itself as long as the same remains active and offered by XXXXXXXX and its integrated Vendors. 3.8. XXXXXXXX reserves the full rights to make any alteration or changes to the Product or any part thereof, or suspend the Product or any part thereof with or without prior notice and XXXXXXXX shall not be liable for any losses or inconveniences to the Receiving Parties resulting therefrom. 3.9. XXXXXXXX may assign or novate all or parts of the Agreement to any third- party by written notice without prior consent from the Receiving Parties and the Receiving Parties agree to make all subsequent Payments whenever applicable to XXXXXXXX as instructed in such further notice.

Availability and Eligibility. 1. The State shall ensure that the number of individuals receiving non-crisis comprehensive services statewide increases at the rate of 50 per year for the term of this agreement, unless the parties agree differently in writing. 2. An individual shall be eligible to enroll for non-crisis comprehensive services if: a. The ISP team determines that in-home support services are inadequate to meet the individual’s needs; and b. The individual, the individual’s family members, or the individual’s representative have requested comprehensive services. 3. Since it is likely that the number of individuals enrolled for non-crisis comprehensive services in a given year will exceed the number of non-crisis comprehensive service slots funded under this Agreement, MHDDSD shall promulgate within 12 months of the effective date of this Agreement a rule establishing a reasonable priority system, for example, requiring the provision of available services first to those individuals with the oldest primary caretakers.

BGSU recognizes the right of a Bargaining Unit Faculty Member to secure free time to attend to pregnancy, childbirth, adoption, xxxxxx care assignment, and related medical conditions without prejudicing that faculty member’s consideration for a salary increment, promotion, and/or tenure. 1.2. Parental leave is available to male and female Bargaining Unit Faculty Members who experience the birth of a child or the adoption or xxxxxx care placement of a child who is less than six (6) years of age. 1.3. Whether taking leave for childbirth, adoption or xxxxxx placement, the leave policies provide options for university paid leave and unpaid leave that are coordinated through the provisions of FMLA, the Ohio Revised Code, and other University leave policies, including, but not limited to, sick leave and vacation leave. Parental leave shall run concurrently with the Bargaining Unit Faculty Member’s approved FMLA Leave (Article 21, Section VI).

Availability and Eligibility. This voluntary Program is available to Idaho Power customers (“Customers”) who are 18 years of age or older and in Good Standing with of any of the following types of electric service accounts located in Idaho Power’s Idaho service area (“Eligible Customers”): Residential Service (Schedules 1 and 5), Small General Service (Schedule 7), Large General Service (Schedule 9), Large Power Service (Schedule 19), Agricultural Irrigation Service (Schedule 24), Micron Special Contract (Schedule 26), Simplot Special Contract (Schedule 29), or the Department of Energy Special Contract (Schedule 30). Non- metered and lighting accounts may not participate in the Program. A Customer is in “Good Standing” if the Customer does not have a past-due balance greater than 60 days’ past due and not greater than $100. If Idaho Power does not receive a minimum number of total Subscriptions for the Program, Idaho Power may terminate the Program and will refund the Subscription Fees, as set forth below under “Refund of Subscription Fee.” Participation in the Program is available on a first-come, first-served basis to all Eligible Customers who complete a Participant Agreement and exercise a Payment Option for the Subscription Fee for this Program (each a “Participant”). Participant or the Participant’s authorized signatory must have full power and authority to execute this Participant Agreement. Participant must be the Customer of record for the service agreement to which the Subscription applies. If there is more than one Customer of record for a customer service agreement, any one Customer of record may make decisions regarding the Subscription. Should an Eligible Customer have more than one customer service agreement, it must designate to which customer service agreement and account the Subscription should apply. Customers that Idaho Power, in its sole discretion, determines are ineligible to participate will be notified promptly. In the event a Customer is deemed ineligible, any Subscription Fee payments received by Idaho Power from such ineligible Customer will be returned without interest. A “Subscription” is a Participant’s applicable portion of the electricity output generated by the community solar array developed in connection with the 500 kW project (the “Community Solar Array”).
