Availability of Internal Practices, Books and Records. MBR agrees to make its internal practices, books and records relating to the Use and Disclosure of Health Information available to the Secretary of the Secretary for purposes of determining Client’s compliance with the Privacy Regulations.
Availability of Internal Practices, Books and Records. Business Associate shall make internal practices, books, and records relating to the use and disclosure of PHI received from, or received by Business Associate on behalf of, Covered Entity available to the Covered Entity, or at the request of Covered Entity to the Secretary, in a time and manner designated by Covered Entity or the Secretary, for purposes of determining Covered Entity's compliance with the Privacy Rule or Security Rule. Business Associate shall notify Covered Entity, in writing, of any request by the Secretary under this Section, and shall provide Covered Entity with a copy of any PHI that Business Associate provides to the Secretary concurrently with providing such PHI to the Secretary. All costs incurred by Business Associate by providing any access or copies pursuant to this Section shall be borne by Covered Entity.

Business Associate agrees to make available to the Secretary of the U.S. Department of Health and Human Services its internal practices, books and records relating to the Use and Disclosure of PHI received from, or created or received by, Business Associate on behalf of, Covered Entity.

Within three (3) business days of receipt of a request from the Secretary for information, Business Associate shall notify Covered Entity, in writing, of the request. Business Associate shall, concurrently with providing information to the Secretary, provide Covered Entity with a copy of any internal practices, books, and records that Business Associate provides to the Secretary.

Employer shall make internal practices, books, and records relating to the use and disclosure of Personal Information received from, or received by Employer on behalf of, KRS available to KRS, in a time and manner designated by KRS, for purposes of determining Employer's compliance with 105 KRS 1:140, this Agreement, and Applicable Law.

Business Associate shall make its internal practices, books and records available to Covered Entity or the Secretary for purposes of determining Covered Entity’s compliance with the HIPAA Authorities, in a time and manner designated by Covered Entity or the Secretary, as applicable. Covered Entity reserves the right to request, and Business Associate shall provide, additional satisfactory assurances that Business Associate is meeting its applicable obligations under the HIPAA Privacy and Security Rules. Such requests may include, but are not limited to; an onsite audit, conducted by Covered Entity or its designee, access to policies and procedures, risk assessment documentation, incident logs or information related to the Business Associate’s Subcontractors compliance with their applicable obligations under the HIPAA Privacy and Security Rules.

Nothing in this Section 2.9 (Availability of Internal Practices, Books, and Records) will waive any applicable privilege or protection, including with respect to trade secrets and Confidential Information.

Availability of Internal Practices, Books and Records. Vendor agrees to make Vendor’s internal practices, books, and records available to the Secretary in accordance with 45 C.F.R. § 160.310 for purposes of the Secretary determining Provider’s compliance with HIPAA.
