Common use of Avoidance of Layoff Clause in Contracts

Avoidance of Layoff. The Employer may either lay off employees in accordance with this Article or, at the option of the Employer, may confer with the Union to determine whether there is mutual agreement on a method for the equitable distribution of the available work in order to avoid, or reduce a layoff. If the Employer does enter into such discussions with the Union, and there is no mutual agreement on a method for the distribution of work, that matter is not arbitrable, and the Employer is entitled to proceed with the layoff.
