Common use of BASIS OF AWARD Clause in Contracts

BASIS OF AWARD. Awards shall be made to the responsive, responsible Bidders that offer the highest MSRP discount per Manufacturer/Brand for any Group line number. The Department reserves the right to award to a single contractor or award to multiple contractors by Manufacturer/Brand, within each Group line number if deemed to be in the best interest of the State. Bidders are not required to bid every Group or every Manufacturer/Brand within a Group. However if the Bidder wishes to be considered for an award, they must submit a bid for the MSRP discount for a Group line number for a Manufacturer/Brand within that Group.
