Common use of Before First Commercial Sale Clause in Contracts

Before First Commercial Sale. Prior to the first commercial sale to an end user purchaser of any LICENSED PRODUCT or first commercial performance of any LICENSED PROCESS, COMPANY shall deliver reports to XXXXXXXXX annually, within [***] days of the end of each calendar year, containing information concerning the immediately preceding calendar year, as further described in Section 5.2.
