Common use of BER Clause in Contracts

BER. Where the Article repair price exceeds 70% of the new build price then this is normally considered to be unacceptable to proceed to repair and no further work shall be undertaken, unless obsolescence prevents manufacture of new parts. All Articles declared as BER are to be disposed of in accordance with Para 9, except where obsolescence has been reported by the Contractor and agreed by the Authority whereby the equipment menu lists would be amended to reflect this requirement.
