h. All bids must be submitted for the guaranteed room night rates proposed. Any attempt to modify the bid document to deviate from Attachment 11 – Proposed Form of Agreement will not be considered and will cause a bid to be rejected.
i. A bid may be rejected if it is conditional or incomplete, or if it contains any alterations of forms or other irregularities of any kind. The State may reject any or all bids and may waive an immaterial deviation in a proposal. The State's waiver of an immaterial deviation shall in no way modify the IFB document or excuse the Bidder from full compliance with all requirements, if awarded a MSA.
j. A deviation from a requirement is material if the response is not in substantial accord with the IFB requirements, provides an advantage to one Bidder over other Bidders, or has a potentially significant effect on the delivery, quantity or quality of items proposed, amount paid to the contractor, or on the cost to the State. Material deviations cannot be waived.
k. The State does not accept alternate Agreement language from a bidder. A bid with such language will be considered a counter proposal and will be rejected. The State’s GTCs are not negotiable. The GTC 04/2017 may be viewed at xxxx://xxx.xxx.xx.xxx/ols/Resources/StandardContractLanguage.aspx
l. Bids that contain false or misleading statements, or which provide references which do not support an attribute or condition claimed by the Bidder, may be rejected.
m. Costs incurred for developing bids and in anticipation of the award of a MSA contract are entirely the responsibility of the Bidder and shall not be charged to the State of California.
n. A Bidder may modify a proposal after its submission by withdrawing its original proposal and resubmitting a new proposal prior to the proposal submission deadline as set forth in the Section D) Bid Requirements and Information, Item 1.
