Common use of BINDINGEFFECT Clause in Contracts

BINDINGEFFECT. Forwarding this Agreement to the Allottee by the Promoter does not create a binding obligation on the part of the promoter or the Allottee until, firstly, the Allottee sings and delivers this Agreement with all the schedules along with the payments due as stipulated in the Payment Plan within 30(thirty) days from the date of receipt by the Allottee and secondly, appears for registration of the same before the concerned Sub-Registrar (ADSR SODEPUR Sub- Registrar) as and when intimated by the Promoter. If the Allottee(s) fails to execute and deliver to the Promoter this Agreement within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Sub-Registrar for its registration within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Sub-Registrar for its registration as and when intimated by the Promoter, then the Promoter shall serve a notice to the Allottee for rectifying the default, which if not rectified within 30 (thirty) days from the date of its receipt by the Allottee, application of the Allottee shall be treated as cancelled and all sums deposited by the Allottee in connection therewith including the booking amount shall be returned to the Allottee without any interest or compensation whatsoever.

If the Allottee(s) fails to execute and deliver to the Promoter this Agreement within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Sub-Registrar for its registration within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Sub-Registrar for its registration as and when intimated by the Promoter, then the Promoter shall serve a notice to the Allottee for rectifying the default, which if not rectified within 30 (thirty) days from the date of its receipt by the Allottee, ,application of the Allottee shall be treated as cancelled and all sums deposited by the Allottee in connection inconnection therewith including the booking amount shall be returned to the Allottee without any interest anyinterest or compensation whatsoever. 21. ENTIREAGREEMENT: This Agreement, along with its schedules, constitutes the entire Agreement between the Parties with respect to the subject matter hereof and supersedes any and all understandings, any other agreements, allotment letter, correspondences, arrangements whether written or oral, if any, between the parties in regard to the said apartment/Plot/Building, as the case may be.

If the Allottee(sAllottee/s(s) fails to execute and deliver to the Vendor/Promoter this Agreement within 30 (thirty) days from the date of its receipt by the Allottee Allottee/s and/or appear before the Registrar/Sub-Registrar for its registration within 30 (thirty) days from the date Registrar/ registrar of its receipt by the Allottee and/or appear before the Sub-Registrar Assurance for its registration as and when intimated by the Vendor/Promoter, then the Vendor/Promoter shall serve a notice to the Allottee Allottee/s for rectifying the default, which if not rectified within 30 (thirty30(thirty) days from the date of its receipt by the Allottee/s, application of the Allottee Allottee/s shall be treated as cancelled and all sums deposited by the Allottee Allottee/s in connection therewith including the booking amount shall be returned to the Allottee Allottee/s without any interest or compensation whatsoever.

If the Allottee(sAllottee/s(s) fails to execute and deliver to the Vendors/Promoter this Agreement within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Sub-Registrar for its registration within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Sub-Registrar for its registration as and when intimated by the Promoter, then the Promoter shall serve a notice to the Allottee for rectifying the default, which if not rectified within 30 (thirty30(thirty) days from the date of its receipt by the Allottee, application of /s and/or appear before the Allottee shall be treated Registrar/Sub-Registrar/ registrarof Assurance for its registration as cancelled and all sums deposited when intimated by the Allottee in connection therewith Vendors/Promoter, then the Vendors/Promoter shall serve a notice tothe Allottee/s for rectifying the default, which if not rectified within 30(thirty) days from the date of its receipt by theAllottee/s,applicationoftheAllottee/sshallbetreatedascancelledandallsumsdeposited bytheAllottee/sinconnectiontherewith including the booking amount shall be returned to the Allottee Allottee/s without any interest or compensation whatsoevercompensationwhatsoever.

BINDINGEFFECT. Forwarding this Agreement to the Allottee Allottee/Purchaser by the Promoter does not create a binding obligation on the part of the promoter Owner/Promoter or the Allottee Allottee/Purchaser until, firstly, the Allottee sings Allottee/Purchaser signs and delivers this Agreement with all the schedules along with the payments due as stipulated in the Payment Plan within 30(thirty30 (thirty) days from the date of receipt by the Allottee Allottee/Purchaser and secondly, appears for registration of the same before the concerned Sub-Sub- Registrar (ADSR SODEPUR Sub- Registrar) as and when intimated by the Owner/Promoter. If the Allottee(s) Allottee/Purchaser fails to execute and deliver to the Owner/Promoter this Agreement within 30 (thirty) days from the date of its receipt by the Allottee Allottee/Purchaser and/or appear before the Registrar/Sub-Registrar for its registration within 30 (thirty) days from the date Registrar/ registrar of its receipt by the Allottee and/or appear before the Sub-Registrar Assurance for its registration as and when intimated by the Owner/Promoter, then the Owner/Promoter shall serve a notice to the Allottee Allottee/Purchaser for rectifying the default, which if not rectified within 30 (thirty30(thirty) days from the date of its receipt by the Allottee/Purchaser, application of the Allottee Allottee/Purchaser shall be treated as cancelled and all sums deposited by the Allottee Allottee/Purchaser in connection therewith including the booking amount shall be returned to the Allottee Allottee/Purchaser without any interest or compensation whatsoever.

Forwarding this Agreement to the Allottee by the Promoter Owner/Developer does not create a binding obligation on the part of the promoter or theOwner/Developeror the Allottee until, firstly, the Allottee sings signs and delivers this Agreement with all the schedules along with the payments due as stipulated in the Payment Plan within 30(thirty30 (thirty) days from the date of receipt by the Allottee and secondly, appears for registration of the same before the concerned Sub-Sub- Registrar (ADSR SODEPUR Sub- Registrar) as and when intimated by the PromoterOwner/Developer. If the Allottee(s) fails to execute and deliver to the Promoter Owner/Developer this Agreement within 30 (thirty30(thirty) days from the date of its receipt by the Allottee and/or appear before the Registrar/Sub-Registrar for its registration within 30 (thirty) days from the date Registrar/ registrar of its receipt by the Allottee and/or appear before the Sub-Registrar Assurance for its registration as and when intimated by the PromoterOwner/Developer, then the Promoter Owner/Developer shall serve a notice to the Allottee for rectifying the default, which if not rectified within 30 (thirty30(thirty) days from the date of its receipt by the Allottee, application of the Allottee shall be treated as cancelled and all sums deposited by the Allottee in connection therewith there with including the booking amount shall be returned to the Allottee without any interest or compensation whatsoeverwhat’s over.

Forwarding this Agreement to the Allottee Allottee/s by the Promoter Vendor/Developer does not create a binding obligation on the part of the promoter Vendor/Developer or the Allottee Allottee/s until, firstly, the Allottee sings Allottee/s signs and delivers this Agreement with all the schedules along with the payments due as stipulated in the Payment Plan within 30(thirty30 (thirty) days from the date of receipt by the Allottee Allottee/s and secondly, appears for registration of the same before the concerned Sub-Sub- Registrar (ADSR SODEPUR Sub- Registrar) as and when intimated by the PromoterVendor/Developer. If the Allottee(sAllottee/s(s) fails to execute and deliver to the Promoter Vendor/Developer this Agreement within 30 (thirty) days from the date of its receipt by the Allottee Allottee/s and/or appear before the Registrar/Sub-Registrar for its registration within 30 (thirty) days from the date Registrar/ registrar of its receipt by the Allottee and/or appear before the Sub-Registrar Assurance for its registration as and when intimated by the PromoterVendor/Developer, then the Promoter Vendor/Developer shall serve a notice to the Allottee Allottee/s for rectifying the default, which if not rectified within 30 (thirty30(thirty) days from the date of its receipt by the Allottee/s, application of the Allottee Allottee/s shall be treated as cancelled and all sums deposited by the Allottee Allottee/s in connection therewith including the booking amount shall be returned to the Allottee Allottee/s without any interest or compensation whatsoever.

Forwarding this Agreement to the Purchaser/Allottee by the Promoter does Developerdoes not create a binding obligation on the part of the promoter or Developeror the Purchaser/Allottee until, firstly, the Allottee sings Purchaser/Allotteesigns and delivers this Agreement with all the schedules along with the payments due as stipulated in the Payment Plan within 30(thirty30 (thirty) days from the date of receipt by the Purchaser/Allottee and secondly, appears for registration of the same before the concerned District Sub-Registrar (ADSR SODEPUR Sub- Registrar) , Kolkata as and when intimated by the PromoterDeveloper. If the Purchaser/Allottee(s) fails to execute and deliver to the Promoter Developer this Agreement within 30 (thirty) days from the date of its receipt by the Purchaser/Allottee and/or appear before the Registrar/ Sub-Registrar for its registration within 30 (thirty) days from the date / Registrar of its receipt by the Allottee and/or appear before the Sub-Registrar Assurance for its registration as and when intimated by the PromoterDeveloper, then the Promoter shall Developershall serve a notice to the Purchaser/Allottee for rectifying the default, which if not rectified within 30 (thirty) days from the date of its receipt by the Purchaser/Allottee, application of the Purchaser/Allottee shall be treated as cancelled and all sums deposited by the Purchaser/Allottee in connection therewith including the booking amount shall be returned to the Allottee without Purchaser/Allotteewithout any interest or compensation whatsoeverwhatsoever .

BINDINGEFFECT. If the Allottee(s) fails to execute and deliver to the Promoter this Sellerthis Agreement within 30 (thirty) days from the date of its receipt by the Allottee Allottee(s) and/or appear before the Sub-Registrar for its registration within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Sub-Sub- Registrar for its registration as and when intimated whenintimated by the PromoterSeller, then the Promoter shall Sellershall serve a notice to the Allottee Allottee(s) for rectifying the default, which if not rectified within 30 (thirty) days from the date of its receipt by the AllotteeAllottee(s), application of the Allottee Allottee(s) shall be treated as cancelled and all sums deposited by the Allottee Allottee(s) in connection therewith including the booking amount shall be returned to the Allottee Allottee(s) without any interest or compensation whatsoever. However, the Allottee(s) shall be liable to pay all the cost incurred by the Sellerin respect of application and allotment of Unit to the Allottee(s), including preparation of this Agreement, postal cost, advocate fees, etc.

If the Allottee(s) fails to execute and deliver to the Promoter Promoter/Owner this Agreement within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Registrar/Sub-Registrar for its registration within 30 (thirty) days from the date Registrar/ registrar of its receipt by the Allottee and/or appear before the Sub-Registrar Assurance for its registration as and when intimated by the Promoter/Owner, then the Promoter Promoter/Owner shall serve a notice to the Allottee for rectifying the default, which if not rectified within 30 (thirty) days from the date of its receipt by the theAllotteeforrectifyingthedefault,whichifnotrectifiedwithin30(thirty)daysfromthedate ofitsreceiptbythe Contd. to next sheet Allottee, application of the Allottee shall be treated as cancelled and all sums deposited by the Allottee in applicationoftheAllotteeshallbetreatedascancelledandallsumsdepositedbytheAllotteein connection therewith including the booking amount shall be returned to the Allottee without any interest or compensation whatsoever.

Forwarding this Agreement to the Allottee by the Promoter Owner/Developer does not create a binding obligation on the part of the promoter Owner/Developer or the Allottee until, firstly, the Allottee sings signs and delivers this Agreement with all the schedules along with the payments due as stipulated in the Payment Plan within 30(thirty) days from the date paymentsdueasstipulatedinthePaymentPlanwithin30(thirty)daysfromthedate of receipt by the Allottee and secondly, appears for registration of the same before the concerned Sub-Registrar (office of DSR/ADSR SODEPUR Sub- Registrar) as Howrahas and when intimated by the Promoter. If the Allottee(s) fails to execute and deliver to the Promoter Owner/Developer this Agreement within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Sub-Registrar for its registration within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Sub-Registrar for its registration as and when intimated by the PromoterOwner/Developer, then the Promoter Owner/Developer shall serve a notice to the Allottee for rectifying the default, which if is not rectified within 30 (thirty) days from the date of its receipt by the Allottee, application of the Allottee shall be treated as cancelled and all sums deposited by the Allottee in connection therewith including the booking amount shall be returned to the Allottee without any interest or compensation whatsoevercompensationwhatsoever.

If the Allottee(sAlottee(s) fails to execute and deliver to the Promoter promoter this Agreement within 30 (thirty) days from the date of its receipt by the Allottee and/or appear before the Sub-Registrar for its registration within 30 (thirty) days from the date of its receipt by the Allottee and/or and / or appear before the Sub-Registrar for its registration as and when intimated by the Promoterpromoter, then the Promoter promoter shall serve a notice to the Allottee for rectifying the default, which if not rectified within 30 (thirty) days from the date of its receipt by the Allottee, Allotee application of the Allottee shall be treated as cancelled and all sums deposited by the Allottee in connection therewith including the booking amount shall be returned to the Allottee without any interest or compensation whatsoever.

If the Allottee(sAllottee/s(s) fails to execute and deliver to the Promoter Vendor this Agreement within 30 (thirty) days from the date of its receipt by the Allottee Allottee/s and/or appear before the Sub-Registrar for its registration within 30 (thirty) days from the date Registrar/Sub- Registrar/ registrar of its receipt by the Allottee and/or appear before the Sub-Registrar Assurance for its registration as and when intimated by the PromoterVendor, then the Promoter Vendor shall serve a notice to the Allottee Allottee/s for rectifying the default, which if not rectified within 30 (thirty30(thirty) days from the date of its receipt by the Allottee/s, application of the Allottee Allottee/s shall be treated as cancelled and all sums deposited by the Allottee Allottee/s in connection therewith including the booking amount shall be returned to the Allottee Allottee/s without any interest or compensation whatsoever.
