Common use of Border Measures Clause in Contracts

Border Measures. Each Party shall, unless otherwise provided for in this Article, adopt procedures (74) to enable a right holder, who has valid grounds for suspecting that the import, export, or transit of goods infringing a copyright or a trademark right (75) may take place, to lodge an application in writing with competent authorities, for the suspension by the customs authorities of the release into free circulation or for the detention of such goods. The Parties will evaluate the appli­ cation of these measures for goods suspected of infringing a geographical indication.
