Protective Measures. We have implemented and will maintain appropriate technical and organisational measures in relation to the Services taking into account the state of the art, the costs of implementation, and the nature, scope, context and purposes of Processing, as well as the likelihood and severity of risk to the rights and freedoms of data subjects. This includes measures relating to the physical security of Our facilities used to deliver them, measures to control access rights to Our assets and relevant networks, and processes for testing these measures. In accordance with Our obligations under applicable law, We may undertake digital forensic investigations in relation to the use of the Services and Subscriptions. You are responsible for using, and ensuring that your Users use, the controls and advice provided by the Services correctly and consistently.

Protective Measures. CONTRACTOR shall be responsible for the proper care and protection of all equipment and materials delivered and the Work performed until final acceptance of the Work and issuance of a notice of completion for that Work Order Package or Request by ANAHEIM. CONTRACTOR shall also adequately protect adjacent property as provided by law and by this Master Agreement, including, but not limited to, protection of any Work existing in public property. CONTRACTOR shall take all necessary precautions for the safety of its employees and the employees of its contractors, subcontractors, or others working on its behalf on the Work and prevent accidents or injury to individuals on, about, or adjacent to the premises where the Work is being performed. In addition, CONTRACTOR shall erect and properly maintain at all times, as required by the conditions and progress of the Work, all necessary safeguards and warnings, including, but not limited to, temporary covering on all equipment pads, for the protection of its employees and the employees of its contractors, subcontractors, or others working on its behalf and the public.

You are responsible for using, and ensuring that your Group and User use, the classification, access controls and other tools provided by the Services correctly and consistently in order to appropriately protect Content. Unless otherwise agreed in writing and delivered as Professional Services by Us under this MSA and an Order Form, you are responsible for any and all customer-side configuration of the Services as directed by Us (including following a Support request) for you, your Group and Users.

Protective Measures. Each of the Contracting Parties shall have a security organisation and security programmes, based upon such basic principles and minimum standards of security which shall be implemented in the security systems of the Contracting Parties, to ensure that at least an equivalent level of protection is applied to classified information subject to this Agreement. The basic principles and minimum standards of security are set out in Articles 4 to 15 of this Annex.
Protective Measures. To protect the confidentiality of the CONFIDENTIAL INFORMATION, the recipient shall take the same measure which it takes to protect the confidentiality of its own confidential information, and shall take those measures which a prudent business person would take to protect valuable, secret, proprietary information.

We also manage our network to facilitate the proper functioning of services that require consistent high speeds, such as video calling, which may, particularly at times and in areas of network congestion, result in reduced speeds for other services. Additionally, we may implement other network management practices, such as caching less data, using less capacity, sizing video more appropriately for a Bark Phone to transmit data files more efficiently, and deploying streaming video optimization technology, which may affect the performance and download times of data-heavy activities such as video-streaming. Streaming video optimization technology is intended to manage data usage on the network, reduce the risk of streaming video stalling and buffering, and reduce the amount of high-speed data consumption used for streaming video. Streaming video optimization improves streaming video reliability as well as makes room for other users to enjoy higher browsing speeds. Detectable video may typically stream at DVD quality or Standard Definition. The streaming video optimization process is agnostic as to the streaming video content itself and to the website that provides it. While most changes to streaming video files are likely to be indiscernible, the optimization process may minimally impact the appearance of the streaming video as displayed on your User(s)’ Bark Phone. These practices operate without regard to the content itself or the source of the content, and do not discriminate against offerings that might compete against those offered by us on the basis of such competition.
