Common use of Bus Testing Clause in Contracts

Bus Testing. (a) The following applies to purchases or leases of any new bus model or any bus model with a major change in configuration or components to be acquired or leased with FTA funds. (b) Contractor agrees to comply with the Bus Testing requirements under 49 U.S.C. § 5318(e) and FTA’s imple- xxxxxxx regulation at 49 C.F.R. Part 665 to ensure that the requisite testing is performed for all new bus models or any bus model with a major change in configuration or components, and that the bus model has achieved a passing score. Upon completion of the testing, the Contractor shall obtain a copy of the bus testing reports from the operator of the testing facility and make that report(s) publicly available prior to final acceptance of the first vehicle by the Authority.
