Cancellation and Refunds. You may cancel this Agreement at any time for any reason by calling 1-800-4-MY-HOME® or by mailing written notice of cancellation to: Cancellation Services, X.X. Xxx 0000, Xxxx Xxxxx, XX, 00000-0000. We may cancel this Agreement if you fail to pay, including via monthly or installment options where applicable, make a material misrepresentation, substantially breach your duties under this Agreement, or if Sears Repair or its representatives determines that it cannot service or repair your Covered Product due to the causes listed in Section 10 of this Agreement. We may also cancel this Agreement if the Covered Products model or serial number is altered, missing or illegible. If this Agreement is cancelled by you or us:  During any time within the full manufacturers warranty period (parts & labor) you will receive a 100% refund of the total price paid for this Agreement.  During the first sixty (60) days of the term you will receive a 100% refund of the total price paid for this Agreement.  After the first sixty (60) days of the term or after the expiration of the full manufacturer’s warranty for the Covered Product (whichever occurs last), excluding warranties covering component parts of the Covered Product, we will refund the total price allocable to the remainder of the Term of this Agreement prorated on a monthly basis.  If you are paying your Agreement via installment or monthly plan, and you cancel your agreement, for the purpose of determining your refund, if any, the total price you paid to date will be deemed the total price of this Agreement. Any refund will be made in the same form as the original payment of this Agreement. If more than one payment method was used, any refund will be applied in the following order: Shop Your Way Reward® Points, Sears gift card, Sears credit card, third-party credit card, and cash/check. No refund will be granted if this Agreement is cancelled after the Covered Product has been replaced. UNDER NO CIRCUMSTANCES WILL YOUR REFUND EXCEED THE VALUE OF THE TOTAL PRICE YOU PAID FOR THIS AGREEMENT.

The amount of refund will be prorated using the Covered Product (whichever occurs last), excluding warranties covering component parts lesser of days or miles of coverage remaining. Cancellation and Refunds. Once you have ordered Products and Services you will be liable to pay Kerb Appealz Ltd the total value. Should you wish to cancel or withdraw any Products or Services you may do so at any time. However, under no circumstances will any full or part credit be made in respect of Advertised Rates. In certain circumstances you may be able to re-list the property within a designated period after withdrawal. Details will be made available about this at the time of seeking to withdraw/relist your advert. Kerb Appealz Ltd Plus Service In consideration of you paying or committing to pay the Product Service Fee and complying in full with these terms and conditions you will be entitled to a Refund of the Product Service Fee after deducting the Administration Charge. In the event you are entitled to a Refund you must make a claim. The conditions in order to make a claim are:- • You may cancel this Agreement have purchased a service at the time you instructed Kerb Appealz Ltd to market your property which includes as part of the service an entitlement to a Refund in accordance with these terms and conditions. • A period of not less than 12 months have passed from the date the Property first came on the market. • The property has been advertised for sale for at least three months prior to the claim at Kerb Appealz Ltd written valuation or less. • You have not at any time refused or prevented potential purchasers from viewing the Property. • You have only advertised and marketed the Property with Kerb Appealz Ltd and have only accepted viewings and offers via Kerb Appealz Ltd. • You have not unreasonably refused an asking price offer. • You have not unreasonably withdrawn from a sale or otherwise unreasonably refused any advice or support from the team at Kerb Appealz Ltd. • Upon receipt of the claim Kerb Appealz Ltd will assess the nature and extent of the information provided and will pay all valid claims within 14 days after deducting the Administration Fee and once it has been confirmed that you have withdrawn the Property and it is no longer on the market. If this Agreement is cancelled by you or us:  During any time within the full manufacturers warranty period (parts & labor) you will receive a 100% refund of the total price paid for this Agreement.  During the first sixty (60) days of the term you will receive a 100% refund of the total price paid for this Agreement.  After the first sixty (60) days of the term or after the expiration of the full manufacturer’s warranty for the Covered Product (whichever occurs last), excluding warranties covering component parts of the Covered Product, we will refund the total price allocable to the remainder of the Term of this Agreement prorated on a monthly basis.  If you are paying your Agreement via installment or monthly plan, and you cancel your agreement, for the purpose of determining your refund, if any, the total price you paid to date there will be deemed the total price no full or part credit in respect of this Agreement. Any refund will be made in the same form as the original payment of this Agreement. If more than one payment method was used, any refund will be applied in the following order: Shop Your Way Reward® Points, Sears gift card, Sears credit card, third-party credit card, and cash/check. You acknowledge that the Platform enables you to pay and the Service Providers to accept the payment for the Services. You acknowledge that all the transactions are between you and the Service Providers and that we are simply facilitating the payment of applicable charges on behalf of the Service Providers. We are a mobile application and therefore not a bank, credit union, payment processor or any other financial institution. All payments are completed through third party payment gateways. You authorize Us to process your payment for the Services provided using the payment information you have supplied.
