Common use of Capacity Interconnection Rights Clause in Contracts

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 1331 MW. 1349 MW commencing June 1, 2022. From the effective date of this ISA until May 31, 2022 (the “interim time period”), in addition to the 1331 MW of Capacity Interconnection Rights the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 1331 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 2022. The amount of Capacity Interconnection Rights specified above (1331 MW) includes 1320 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 11 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request.

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the PJM Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection location specified in this Interconnection Service Agreement Section l.Ob above in the amount of 1331 2224 MW. 1349 MW commencing June 1, 2022. From However,in the effective date event that Interconnection Customer satisfies the milestone stated in Section 6.5 of this ISA until May 31Agreement, 2022 (the “interim time period”), in addition to the 1331 MW of Capacity Interconnection Rights the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 1331 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222256 MW. The amount of Capacity Interconnection Rights specified above above. (1331 2224 MW) includes 1320 2186 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection bus prior to its Interconnection Request associated with this Interconnection Service Agreement, and 11 38 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request. In the event that Interconnection Customer satisfies the milestone stated in Section 6.5 of this Agreement with respect to both Units 2 and 3, its Capacity Interconnection Rights at the location stated in Section 1.0b above shall total 2256 MW, representing its 2186 MW of Capacity Interconnection Rights prior to the Interconnection Request associated with this Interconnection Service Agreement, plus 70 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request. In the event that Interconnection Customer satisfies the milestone stated in Section 6.5 of this Agreement with respect to either Unit 2 or Unit 3, but not both units, its Capacity Interconnection Rights at the location stated in Section 1.0b above shall total 2240 MW, representing its 2186 MW of Capacity Interconnection Rights prior to the Interconnection Request associated with this Interconnection Service Agreement, plus 54 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request.

Capacity Interconnection Rights. From the effective date of this ISA until May 31, 2022 2020 (the “interim time period”), in addition to the 1331 672 MW of Capacity Interconnection Rights the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 20 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 1331 672 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 20 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222020. The amount of Capacity Interconnection Rights specified above (1331 692 MW) includes 1320 672 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 11 20 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request.

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the total amount of 1331 MW. 1349 940 MW commencing on June 1, 20222020. From Capacity Interconnection Rights may be awarded to Interconnection Customer prior to June 1, 2020 as described below. The amount of Capacity Interconnection Rights specified above (940 MW) includes 900 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection associated with Queue Position #T174, and 40 MW of Capacity Interconnection Rights associated with Queue Position # AB1-106. During the time period from the effective date of this ISA until to May 31, 2022 2020 (the “interim time period”), in addition to the 1331 900 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISAthe Queue Position #T174 Interconnection Request, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 40 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 1331 900 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 40 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 2022. The amount of Capacity Interconnection Rights specified above (1331 MW) includes 1320 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 11 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request2020.

Capacity Interconnection Rights. From the effective date of this ISA until May 31, 2022 2021 (the “interim time period”), in addition to the 1331 725 MW of Capacity Interconnection Rights the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 75 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 1331 725 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 75 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222021. The amount of Capacity Interconnection Rights specified above (1331 800 MW) includes 1320 725 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 11 75 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request.

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 1331 535 MW. 1349 Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 535580 MW commencing June 1, 20222017. From 2021. During the time period from the effective date of this ISA until May June 1, 2017May 31, 2022 2021 (the “interim time period”), in addition to the 1331 MW of Capacity Interconnection Rights the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an anthe amount not to exceed 18 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 1331 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 53550.4 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 202220172021. The amount of Capacity Interconnection Rights specified above (1331 535580 MW) includes 1320 509529.6 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 11 2650.4 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request.

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 1331 250 MW. 1349 262.9 MW commencing June 1, 2022. From the effective date of this ISA until May 31, 2022 (the “interim time period”), in addition to the 1331 243.9 MW of Capacity Interconnection Rights the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 19 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 1331 243.9 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 19 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 2022. The amount of Capacity Interconnection Rights specified above (1331 250 MW) includes 1320 235 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 11 15 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request.

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 1331 1370 MW. 1349 MW Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights commencing June 1, 20222020. From During the time period from the effective date of this ISA until May 31, 2022 2020, (the “interim time period”), in addition to the 1331 Interconnection Customer shall have 1350 MW of Capacity Interconnection Rights the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded on a non-interim Capacity Interconnection Rights in an amount not to exceed 18 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 1331 MW of previously awarded Capacity Interconnection Rights basis and may be awarded interim Capacity Interconnection Rights on an interim basis in an amount not to exceed 18 20 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222020. The amount of Capacity Interconnection Rights specified above (1331 1370 MW) includes 1320 1350 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 11 20 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request.

Capacity Interconnection Rights. For Unit 1: Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 1331 MW. 1349 167 MW commencing June 1, 20222021. From the effective date The amount of this ISA until May 31, 2022 Capacity Interconnection Rights specified above (the “interim time period”), in addition to the 1331 167 MW) includes 152 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point Point(s) of Interconnection prior to its Interconnection Request associated with this ISAInterconnection Service AgreementPJM Queue Position No. AC1-109/AC1-111, the Interconnection Customer also may be awarded interim and 15 MW of Capacity Interconnection Rights in an amount not granted as a result of such Interconnection Request. The amount of Capacity Interconnection Rights specified above (1331 167 MW) includes 1320 152 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service AgreementPJM Queue Position No. AC1-109/AC1-111, and 15 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request. For Unit 3: Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 152167 MW commencing June 1, 2021. The amount of Capacity Interconnection Rights specified above (152167 MW) includes 152 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 11 015 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request. For Unit 4: Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 152167 MW commencing June 1, 2021. The amount of Capacity Interconnection Rights specified above (152167 MW) includes 152 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 015 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request. For Unit 5: Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 51 MW commencing June 1, 2021. The amount of Capacity Interconnection Rights specified above (51 MW) includes 45 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service AgreementPJM Queue Position No. AC1-109/AC1-111, and 6 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request. For Unit 6: Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 51 MW commencing June 1, 2021. The amount of Capacity Interconnection Rights specified above (51 MW) includes 45 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service AgreementPJM Queue Position No. AC1-109/AC1-111, and 6 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request. For Unit 10: Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 51 MW commencing June 1, 2021. The amount of Capacity Interconnection Rights specified above (51 MW) includes 45 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service AgreementPJM Queue For all units (aggregated): The amount of Capacity Interconnection Rights specified above (944974 MW) includes 878944 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 6630 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request.

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 1331 MW. 1349 120 MW commencing on June 1, 2022. From During the time period from the effective date of this ISA until May 31, 2022 2020 (the “first interim time period”), in addition to the 1331 47.5 MW of Capacity Interconnection Rights the Interconnection Customer had has at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights associated with PJM Queue #AC2-066 in an the amount not to exceed 18 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 1331 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 28.5 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the first interim time period shall terminate May 31, 2020. Interconnection Customer shall have a total of 76 MW of Capacity Interconnection Rights associated with Queue #AB1-014 and #AC2-066, commencing on June 1, 2020. During the time period from June 1, 2020, to May 31, 2022 (the “second interim time period”), in addition to the 76 MW of Capacity Interconnection Rights the Interconnection Customer has at the same Point of Interconnection associated with PJM Queue #AB1-014 and #AC2-066, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights associated with PJM Queue #AE1-120 in an amount not to exceed 44 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the second interim time period shall terminate on May 31, 2022. The amount Interconnection Customer shall have a total of Capacity Interconnection Rights specified above (1331 MW) includes 1320 120 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service AgreementQueue #AB1-014, #AC2-066, and 11 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request#AE1- 120, commencing on June 1, 2022.

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have the additional 33 MW of Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 639.8 MW commencing June 1, 20222015. During the time period from2021. From the effective date of this ISA until May 31, 2022 20152021 (the “interim time period”), in addition to the 1331 553.2 MW of Capacity Interconnection Rights the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded these additional 33 MW of interim Capacity Interconnection Rights in an the amount not to exceed 18 86.6 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 1331 553.2 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 18 86.6 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 2022. The amount of Capacity Interconnection Rights specified above (1331 MW) includes 1320 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 11 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request20152021.
