CAPACITY OF PURCHASER. 19.1 If more than one Purchaser signs this Agreement, the Purchasers will be jointly and severally liable for the due performance of the terms and conditions of this Agreement. This Agreement will at all times be binding on the Purchaser’s heirs, administrators, assigns or successors in title. 19.2 The Signatory shall in his personal capacity be liable for the due fulfilment of all the terms and conditions of this Agreement. 19.3 Should the Purchaser be a company to be founded and the company is not founded within 30 (Thirty) days after the Signature Date, or if the company is founded, but does not ratify this Agreement, or if the company does not comply with the terms and conditions of this Agreement, then in that instance the Signatory will be liable to perform all terms and conditions of this Agreement in his personal capacity.

The Signatory, on behalf of a legal persona, shall in his personal capacity be liable for the due fulfilment of all the terms and conditions of this Agreement and binds himself to the Seller as surety with and co-principal debtor in solidum with the Purchaser under renunciation of the benefits of excussion and division for the performance by the Purchaser of all the Purchaser’s obligations in terms of this Agreement.
CAPACITY OF PURCHASER. Should the purchaser sign this agreement as trustee of a trust or agent for a company to be formed, the signatory shall be deemed to be personally liable in terms of this agreement should the company not be incorporated or not ratify and adopt this agreement within 20 (twenty) days from the date the purchaser signed this agreement. Upon incorporation and ratification as aforesaid the purchaser by his signature hereto binds himself as surety for and co-principal debtor jointly and severally and in solidum with the company or close corporation for the due and punctual performance by the purchaser of its obligations arising out of this agreement.
CAPACITY OF PURCHASER. 18.1 If the Purchaser is married under foreign law, the Purchaser hereby warrants that his/her spouse shall sign all documents as may be required by the attorneys to enable Transfer and the bond, if applicable. 18.2 If more than one Purchaser signs this Agreement, the Purchasers will be jointly and severally liable for the due performance of the terms and conditions of this Agreement. This Agreement shall at all times be binding on the Purchaser’s heirs, administrators, assigns or successors in title. 18.3 The Signatory shall in his personal capacity be liable for the due fulfilment of all the terms and conditions of this Agreement.
CAPACITY OF PURCHASER. 10.1 Should the Purchaser be married in community of property he/she warrants that his/her spouse shall forthwith countersign this agreement where indicated at the foot hereof and thereby: 10.1.1 contractually assist him/her herein as far as may be necessary, if at all; and 10.1.2 bind him/herself as surety and co-principal debtor jointly and severally with him/her for all his/her obligations arising from this agreement; and 10.1.3 commit him/herself also to assist and so bind him/herself in respect of the Purchaser's application and to procure a mortgage loan/s and in respect of the mortgage loan/s itself, as contemplated in Clause 9 hereof, should any proposed mortgagee so require. 10.2 Should there be a plurality of Purchasers in terms of this Agreement, their obligations arising from this agreement shall be joint and several. 10.3 Should the Purchaser sign this agreement as trustee or agent for a company or close corporation, the signatory shall be deemed to be personally liable in terms of this agreement should the company or close corporation not be incorporated or not ratify and adopt this agreement within 21 (twenty one) days of the date of signature hereof by the Purchaser and/or do not furnish the seller's attorneys with all company or close corporation registration documentation within 30 (thirty) days from date of signature hereof by the purchaser. Upon incorporation and ratification as aforesaid signatory by its signature hereto binds himself as surety for and co-principal debtor in solidum with the company or close corporation for the due and punctual performance by the company or close corporation purchaser of its obligations arising out of this agreement.

CAPACITY OF PURCHASER. 10.1 Already formed Entity 10.1.1 that he is duly authorised to enter into this agreement on behalf of the company, close corporation or trust; 10.1.2 that the company, close corporation or trust is lawfully entitled to acquire and take transfer of the Property; 10.1.3 that all conditions have been complied with in order to make this agreement binding to the company, close corporation or trust; 10.1.4 that the company, close corporation or trust will duly and punctually comply with all its obligations in terms of this agreement; and binds himself in his personal capacity by virtue of his signature hereto as surety and co- principal debtor jointly and severally with the legal persona for due and punctual performance of all the terms and conditions of this agreement. 10.2 Purchaser acting as trustee for Company to be formed
CAPACITY OF PURCHASER. The person who signs this Agreement on behalf of such Company or Close Corporation or Trust or other legal person by his signature hereto binds himself in favour of the Seller as SURETY FOR AND CO-PRINCIPAL DEBTOR with such Company or Close Corporation or trustees of a Trust or other legal person for the due and timeous performance by it of all its obligations as Purchaser in terms of this Agreement and furthermore by his signature hereto indemnifies the Seller against any damages that it may suffer as a result of the breach of any of the terms of this Agreement by such Company or Close Corporation or Trustees of a Trust or other legal person.
CAPACITY OF PURCHASER. If the Purchaser signs this Agreement as a principal in terms of a contract for the benefit of a third party, the latter being a company or close corporation to be incorporated the Purchaser in his personal capacity shall be regarded as the Purchaser in terms of this Agreement unless the said company or close corporation is incorporated and duly adopts and ratifies this Agreement within 60 (sixty) days after the date upon which the Seller signs this Agreement. In the event of the said company or close corporation being duly incorporated and adopting and ratifying this Agreement in terms as set out above then the Purchaser, by his signature hereto, hereby interposes and binds himself in favour of the Seller as surety and co-principal debtor in solidum with such company or close corporation for the due and timeous performance by it of all of its obligations as Purchaser in terms of this Agreement.
