Certain Relief Events Causing Closures During Operating Period. ‌ If a Relief Event described in clause (a), (b), (j) (but only a violation by a third party), (k) (but only by a Governmental Entity), (l), (m), (n) (but only a third party release), (o), (q), (r), (t) or (u) of the definition of Relief Event results in a Closure, then solely for purposes of the definition of Unavailability Event such a Closure shall not be deemed a Permitted Closure; provided that:

Certain Relief Events Causing Closures During Operating Period. If a Relief Event described in clause (a) or (l) of the definition thereof results in a Closure of one or more Segments, and Developer uses commercially reasonable efforts to mitigate the effects of such Relief Event and the resulting Closure, then such a Closure shall be deemed a Permitted Closure for as long as such Closure persists or up to [30] days, whichever is less. If such Closure persists more than [30] days, it shall not be deemed to be a Permitted Closure after the first [30] days. If such Closure persists for more than [60] days, then notwithstanding any Unavailability Event, in relation to the Segment or Segments affected by such Closure each Hour, beginning on the [61st] day and continuing for as long as such Closure persists or up to [270] additional days, whichever is less, shall use an Hourly Unavailability Factor of [0.2] for the purposes of calculating the Hourly Unavailability Adjustments for these Hours as described in Appendix 6.

  • OPERATING DURING CLOSURE PERIOD If permission is granted to operate during a closure period listed in Clause 1-25 ACTIVITY TIMING RESTRICTION, Purchaser shall provide a maintenance plan to include further protection of state resources. Purchaser shall obtain written approval from the Contract Administrator for the maintenance plan, and shall put preventative measures in place before operating during the closure period. Purchaser is required to maintain all haul roads at their own expense including those listed in Contract Clause C-060 DESIGNATED ROAD MAINTAINER. If other operators are using, or desire to use these designated maintainer roads, a joint operating plan must be developed. All parties shall follow this plan.

  • OPERATION OF PROPERTY DURING AGREEMENT PERIOD The Seller will continue to operate the Property and any business conducted on the Property in the manner operated prior to the Agreement and will take no action that would adversely impact the Property, tenants, lender, or business, if any. Any changes, such as renting vacant space, that materially affects the Property or the Buyer's intended use will be permitted only with the Buyer's consent.

  • Recovery of Schedule Delays During Last Sixty Days of Contract Time At any time during the last sixty days of the Contract Time that the Design Professional finds that the Contractor is behind schedule per the Contract Time, as amended, the Design Professional shall notify the Contractor in writing. Within seven days of the date of the Design Professional's notice, the Contractor shall prepare and deliver to the Design Professional and Owner a written plan explaining how the Contractor intends to bring the Project back on schedule. The Contractor's plan must provide sufficient detail to allow the Design Professional and Owner to determine the proposal's feasibility.

  • Addressing Objections Raised During Public Comment Period The Parties agree that the procedure contemplated for public review of this Stipulated Order and the Regional Water Board’s or its delegate’s adoption of this Stipulated Order is lawful and adequate.
