Noncompliance Points definition

Noncompliance Points means the points that may be assessed for certain breaches or failures to perform by DB Contractor, as set forth in Exhibit 16 to this DBA.
Noncompliance Points has the meaning assigned to it in the Project Agreement. “Operating Period Closure Deductions” has the meaning assigned to it in the Project Agreement.
Noncompliance Points means the points that may be assessed for certain breaches or failures to perform by Maintenance Contractor, as set forth in Exhibit 16 to the Comprehensive Maintenance Agreement.

More Definitions of Noncompliance Points

Noncompliance Points means the points that may be assessed for certain breaches or failures to perform by Developer, as set forth in Table 2 of Exhibit 18.
Noncompliance Points means the points of that description which may be allocated in accordance with noncompliance points system schedule to the Concession Agreement.
Noncompliance Points means the points that may be assessed for certain Noncompliance Events by the Development Entity, as set out in Schedule 7 (Noncompliance Points Table) to this PPA.

Related to Noncompliance Points

  • Non-Compliance means failure/refusal to comply the terms and conditions of the tender;

  • Environmental Compliance means actions performed during or after Operations to comply with the requirements of all Environmental Laws or contractual commitments related to reclamation of the Properties or other compliance with Environmental Laws.

  • Performance Requirements The ordering entity reserves the right to inspect and verify that all deliveries are in accordance with specifications, both at the point of delivery and at the point of use. For orders that specify an “authorized party” to receive and inspect deliveries and/or installations, acceptance and inspection procedures must be performed by the” authorized party” to be considered and accepted by the ordering entity. Products inspected at the time of use are subject to refusal and return requirements for issues of quality such as defects in manufacturing and/or workmanship. Products will not be considered accepted by the ordering entity until the installation is complete for the applicable products.

  • Environmental Laws means any and all Federal, state, local, and foreign statutes, laws, regulations, ordinances, rules, judgments, orders, decrees, permits, concessions, grants, franchises, licenses, agreements or governmental restrictions relating to pollution and the protection of the environment or the release of any materials into the environment, including those related to hazardous substances or wastes, air emissions and discharges to waste or public systems.
