Cessation or Termination Clause Samples
The Cessation or Termination clause defines the conditions under which an agreement or contractual relationship may be brought to an end. It typically outlines the specific events, breaches, or notice requirements that allow either party to terminate the contract, such as non-performance, insolvency, or mutual agreement. This clause serves to provide a clear and structured process for ending the contract, thereby reducing uncertainty and protecting the interests of both parties in the event that continuation of the agreement is no longer viable or desirable.
Cessation or Termination of Employment with an Employer
(a) Notwithstanding any other provision in this clause, an Employer may, without prior notice, dismiss a clinical academic for refusal to obey lawful orders or for serious misconduct.
(b) A clinical academic who is dismissed may appeal to a Board of Reference if the application is made within one month of the operative date of the dismissal.
(c) A clinical academic may terminate the contract of employment with an Employer by giving to the Employer not less than three months’ notice in writing provided that the Employer and the clinical academic may agree to a shorter period of notice. In lieu of giving the required notice, the clinical academic may forfeit salary commensurate with the residual period of notice otherwise required.
Cessation or Termination of Employment with the Employing Authority
7.3.1 Notwithstanding any other provision in this clause, a Clinical Academic can be terminated in accordance with Part 4-1-7 of the DH Human Resources Manual.
7.3.2 A Clinical Academic may terminate the contract of employment with an employing authority by giving to the employing authority not less than three month’s notice in writing provided that the employing authority and the Clinical Academic may agree to a shorter period of notice. In lieu of giving the required notice, the Clinical Academic may forfeit salary commensurate with the residual period of notice otherwise required.
