Common use of Changes in Law/Interpretation of Laws Clause in Contracts

Changes in Law/Interpretation of Laws. The Parties to this Addendum acknowledge that Medicaid managed care plans are highly regulated by federal statutes and regulations. The Parties further acknowledge that any and all references to Code of Federal Regulation (C.F.R.) citations and other statutes and regulations applicable to Medicaid managed care, are to those in effect on October 15, 2020. The Parties acknowledge and expect that changes may occur over the term of this Addendum regarding federal or State Medicaid statutes and regulation and State statutes and rules governing health insurers and the practice of health care professions. In the event any indicated C.F.R. citation, federal or State Medicaid statute or regulation or State statute or rule governing health insurers and the practice of health care professions or related requirements are amended during the term of this Addendum, the Parties shall be mutually bound by the amended requirements in effect at any given time following the effective date of this Addendum. The explicit inclusion of some statutory and regulatory duties in this Addendum shall not exclude other statutory or regulatory duties. All questions pertaining to the validity, interpretation and administration of this Addendum shall be determined in accordance with the laws of the State of Oklahoma, regardless of where any service is performed. If any portion of this Addendum is found to be in violation of State or federal statutes, that portion shall be stricken from this Addendum and the remainder of this Addendum and Agreement shall remain in full force and effect.
