Changes in Mandatory Subjects Not Specifically Established by the Agreement. The parties agree the City may implement changes in terms and conditions of employment during the term of the Agreement where the subject matter of the change is a mandatory subject of bargaining under Ohio Revised Code (ORC), Chapter 4117, and where the Agreement does not expressly address the subject matter of the change after giving the Union notice of the proposed change and a reasonable opportunity to bargain about it. In the event the parties do not reach an agreement about the proposed change, parties agree that the Union may choose to grieve the matter to arbitration pursuant to the arbitration provisions of Section 8.2, Step 3 except that the parties shall share the expenses equally. The City will not implement its proposed change until the arbitrator issues an award, unless the Union chooses not to grieve in which case the City may implement its final proposal.
