Common use of Children with Disabilities Clause in Contracts

Children with Disabilities. Attainment of the limiting age by a dependent child shall not operate to exclude from or terminate the coverage of such child, while such child is and continues to be both: i. incapable of self-sustaining employment by reason of mental retardation or physical handicap; and ii. chiefly dependent upon the Subscriber for support and maintenance, provided proof of such incapacity and dependency is furnished to AvMed by the Subscriber within 30 days after the date the child attains the limiting age and subsequently as may be required by AvMed, but not more frequently than annually after the two-year period following the child's attainment of the limiting age.
