CHOICE OF FORUM AND CHOICE OF LAW. In the event that a dispute arises out of or in connection with this Limited Warranty, then any claims or suits of any kind concerning such disputes shall only and exclusively be brought in either the Court of Common Pleas of Delaware County, Pennsylvania or the United States District Court for the Eastern District of Pennsylvania. CHOICE OF FORUM AND CHOICE OF LAW. 1. Any disputes arising from an Agreement with the Buyer to which these standard conditions apply, or further to related agreements, will be submitted in first instance to the competent court of The Hague, the Netherlands, which will have exclusive jurisdiction, unless the parties, before either party has filed proceedings, have agreed in writing that the dispute will be settled by arbitration to the exclusion of the ordinary court, in accordance with the regulations of the Raad van Arbitrage voor de Bouw [Court of Arbitration for Construction] as applicable at the time when the dispute is filed.

  • Choice of forum and jurisdiction (a) Any dispute arising from these Clauses shall be resolved by the courts of an EU Member State.

The Parties agree that either or both of them may file a copy of this paragraph with any court as written evidence of the knowing, voluntary and freely bargained for agreement between the Parties irrevocably to waive any objections to venue or to convenience of forum.
