Common use of City Reservation of Rights Clause in Contracts

City Reservation of Rights. Notwithstanding any other provision in this Agreement, pursuant to RCW 36.70B.170(4), the City reserves the authority to impose new or different regulations to the extent required by a serious threat to public health or safety, as determined by the City Council after written notice to and an opportunity to be heard by Developer.

City Reservation of Rights. Notwithstanding any other provision in this Agreement, pursuant to RCW 36.70B.170(4)Section 10 herein, the City reserves the authority under RCW 36.70B.170(4) to impose new or different regulations regulations, which shall supersede this Development Agreement, to the extent required by the federal or state governments, or by a serious threat to t public health or and safety, as determined by the City Council after written notice to and an opportunity to be heard by Developer.
