Common use of CLAIMS AND DISPUTES General Clause in Contracts

CLAIMS AND DISPUTES General. To preserve any claim arising out of the Contract, the parties shall comply with and exhaust all provisions of this Section. Unless otherwise agreed in writing, the parties hereto shall continue diligently to fulfill their respective obligations hereunder during the pendency of any dispute resolution process. If the Consultant continues to perform, the Authority shall continue to make payments in accordance with the Contract of amounts not in dispute. Failure to follow the dispute resolution process herein, including specifically the requirement that the Consultant notify the Authority promptly of any claim shall be deemed a waiver by the Consultant of the applicable claim.
