Common use of Claims of Unjust Discharge Clause in Contracts

Claims of Unjust Discharge. a) A claim by an employee that he has been unjustly discharged from his employment shall be treated as a grievance if a written statement is lodged with the Plant Manager or his nominee within five (5) working days after the employee ceases to work for the Company. An employee discharged shall have the right to interview his Unit Chairman or Committeeman or a Union nominee at a place designated by the Company before he leaves the premises. The Company agrees to notify the Union, in writing, of any employee within the bargaining unit who is discharged. b) Such special grievances may be settled by confirming Management's decision in dismissing the employee or by reinstating the employee with full, partial or no compensation for the time lost as seems just and equitable in the opinion of the conferring parties or the Arbitration Board, as the case may be.
