CLASS NOTICE AND DUTIES AND RESPONSIBILITIES OF THE SETTLEMENT ADMINISTRATOR. Defendants recommend Xxxxx LLC to be the Settlement Administrator for this Agreement, without objection from Class Counsel. A copy of Xxxxx LLC’s CV is attached as Exhibit D. Defendants reserve the right to select a different Settlement Administrator if necessary, and prior to filing a Motion for Preliminary Approval, subject to Class Counsel’s approval, which shall not be unreasonably withheld. The Settlement Administrator shall abide by and shall administer the Settlement in accordance with the terms, conditions, and obligations of this Agreement and the Orders issued by the Court in this Action.
