Common use of Code Enforcement Clause in Contracts

Code Enforcement. The Town will assist the Fire District in enforcing the Town Fire Code within the Town's jurisdiction. The Fire District will assist the Town in enforcing the Town's municipal code, including but not limited to, building, mechanical, and electrical codes, as adopted and from time to time amended by the Town, within the Town's jurisdiction. As provided in the Special District Act, the Fire District shall refer a Town Fire Code violation or a suspected person to the Town prosecutor for prosecution in the Lyons Municipal Court, or to the District Attorney for Boulder County for prosecution in the County or District Courts. The Town also may request that the Fire District prosecute an enforcement action in Boulder County District Court, utilizing the Fire District's legal counsel.
