Collection and Maintenance of Data. Contractor shall maintain its records in such a manner as to provide a clear distinction between the following: The direct cost of Work for which it is entitled (or for which it believes it is entitled) to an increase in the Contract Amount; and The costs of other operations. Contractor shall contemporaneously collect, record in writing, segregate and preserve the following: All data necessary to determine the costs described in this Article 14.13 with respect to all Work which is the subject of a Time and Materials Change Order, specifically including costs associated with design Work, but specifically excluding all negotiated Change Orders; and All data necessary to show the actual impact (if any) of the change on the Critical Path with respect to all Work which is the subject of a Time and Materials Change Order, if the impact on the Owner approved Baseline Program is in dispute. Such data shall be provided to Owner on forms approved by Owner. The cost of furnishing such reports is included in Contractor’s predetermined overhead and profit xxxx-ups.
