Common use of Commencement of Full Operations Clause in Contracts

Commencement of Full Operations. 5.1. The Authority shall authorise the Commencement of Full Operations on the date specified in Section 4 - Statement of Service Requirements, if the Contractor either: (a) has complied fully with the requirements set out in the Statement of Service Requirements relating to the Setting up Operations; or (b) has otherwise demonstrated to the satisfaction of the Authority his capacity to deliver the Services to be provided following the Commencement of Full Operations. 5.2. If the Authority has not authorised the Commencement of Full Operations in accordance with Condition 5.1 (Commencement of Full Operations), the Authority shall have the right, after taking into account all representations made by the Contractor, either: (a) to extend the Setting up Operations for such period as may be specified by the Authority, during which period the Contractor shall correct the fault or deficiency which caused the Authority to withhold authorisation for the Commencement of Full Operations; or (b) to terminate the Contract, or to terminate the provision of any part of the Services, in accordance with Condition 43 (Termination on Default). 5.3. Where the Authority has not authorised the Commencement of Full Operations on the expiration of any extension of the Setting up Operations under Condition 5.2(a) (Commencement of Full Operations), the Authority shall have the right to repeat the exercise of the options set out in Condition 5.2 (Commencement of Full Operations).
