Common use of Commencement of Improvements Clause in Contracts

Commencement of Improvements. Prior to or on the date FRANCHISEE signs a lease with respect to the Center Site or the date of commencement of the improvements or construction of the Center Site, whichever is earlier, FRANCHISEE shall pay to FRANCHISOR the sum of Twenty-Five Thousand Dollars ($25,000) (or Twelve Thousand Five Hundred Dollars ($12,500) in the case of additional franchises). After such payment by FRANCHISEE, such portion of the Initial Franchise Fee shall not be refundable.
