Common use of Commercial Licenses Clause in Contracts

Commercial Licenses. Selexis hereby grants to Merrimack and its Affiliates a non-exclusive license (“Commercial License”) in the Territory, with the limited right to sublicense as per clause 2.2 hereafter, under the Selexis Technology, subject to the terms and conditions of the Agreement, to use Cell Lines for the manufacture of Products in the Licensed Field of Use and to develop, make, have made, use, offer for sale, sell, import and otherwise exploit Products, including the use of Products in research and Clinical Trials.

Commercial Licenses. Selexis hereby grants to Merrimack COMPANY and its Affiliates a non-exclusive license (“Commercial License”) in the Territory, with the limited right to sublicense as per clause 2.2 hereafter, under the Selexis Technology, subject to the terms and conditions of the Agreement, to use Cell Lines for the manufacture of Products in the Licensed Field of Use and to develop, make, have made, use, offer for sale, sell, import and otherwise exploit Products, including including, without limitation, the use of Products in research and Clinical Trials.

Commercial Licenses. Selexis hereby grants to Merrimack COMPANY and its Affiliates a non-exclusive license (“Commercial License”) in the Territory, with the limited right to sublicense as per clause Section 2.2 hereafter, under the Selexis Technology, subject to the terms and conditions of the Agreement, to use Cell Lines for the manufacture of Products in the Licensed Field of Use Use, either at Company facilities or Contractors (subject to Sections 2.1 and 2.2), and to develop, make, have made, use, offer for sale, sell, import import, export and otherwise exploit Products, including including, without limitation, the use of Products in research and Clinical Trials.

Commercial Licenses. Selexis hereby grants to Merrimack COMPANY and its Affiliates a non-exclusive license (“Commercial License”) in the Territory, with the limited right to sublicense as per clause 2.2 hereafter, under the Selexis Technology, Selexis Know-how and Selexis Patents, subject to the terms and conditions of the Agreement, to use COMPANY Cell Lines for the manufacture manufacture, development and production of Products in the Licensed Field of Use and to develop, make, have made, use, offer for sale, sell, import and otherwise exploit Products, including the use of Products in research and Clinical Trials.
