Utilisation Request (a) Each Utilisation Request is irrevocable and will not be regarded as having been duly completed unless: (i) the proposed Utilisation Date is a Business Day within the Availability Period; (ii) the currency and amount of the Utilisation comply with Clause 5.3 (Currency and amount); (iii) it specifies the Borrower; (iv) the proposed Interest Period complies with Clause 10 (Interest Periods); and (v) it specifies whether or not the Utilisation is an Acquisition Drawdown. (b) Only one Loan may be requested in each Utilisation Request. 5.3 Currency and amount (a) The currency specified in a Utilisation Request must be the Base Currency or an Optional Currency. (b) The amount of the proposed Loan must be: (i) if the currency selected is the Base Currency, a minimum of EUR 5,000,000 for the first Utilisation and EUR 1,000,000 for each subsequent Utilisation; (ii) if the currency selected is dollars, a minimum of the equivalent of EUR 5,000,000 in dollars for the first Utilisation and a minimum of the equivalent of EUR 1,000,000 for each subsequent Utilisation; and (iii) if the currency selected is an Optional Currency (other than dollars), the minimum amount (and if required integral multiple) specified by the Agent pursuant to paragraph (b)(ii) of Clause 4.4 (Conditions relating to Optional Currencies), or, in each case, if less, the Available Facility; or (iv) in any event such that its Base Currency Amount is less than or equal to the Available Facility. 5.4 Lenders' participation (a) If the conditions set out in this Agreement have been met each Lender shall make its participation in each Loan available by the Utilisation Date through its Facility Office. (b) The amount of each Lender's participation in each Loan will be equal to the proportion borne by its Available Commitment to the Available Facility immediately prior to making the Loan.

Subject to Clause 10.5 (Utilisation Requests), each Utilisation Request is irrevocable and will not be regarded as having been duly completed unless: 5.2.1.1. the proposed Utilisation Date is a Business Day within the Availability Period; 5.2.1.2. the currency and amount of the Utilisation comply with Clause 5.3 (Currency and amount); and 5.2.1.3. it identifies the proposed first Interest Period and that Interest Period complies with Clause 9 (Interest Periods). 5.2.2. Only one Loan may be requested in each Utilisation Request. 5.3. Currency and amount 5.3.1. The currency specified in a Utilisation Request must be ZAR. 5.3.2. The amount of the proposed Loan must be an amount which is not more than the Available Facility and which is a minimum of ZAR50,000,000 (fifty million Rand) or, if less, the Available Facility. 5.4. Lenders' participation 5.4.1. If the conditions set out in this Agreement have been met, and subject to Clause 6.1 (Repayment of Loans) each Lender shall make its participation in each Loan available by the Utilisation Date. 5.4.2. The amount of each Lender's participation in each Loan will be equal to the proportion borne by its Available Commitment to the Available Facility immediately prior to making the Loan. 5.4.3. The Agent shall notify each Lender of the amount of each Loan and the amount of its participation in that Loan by not later than noon (Johannesburg time) on the date that is 3 (three) Business Days before the proposed Utilisation Date. 5.5.

S. in degree in Air Conditioning, Heating and Refrigeration Technology (GeoExchange track)- 10-601-1 fulfills only the Reading and Writing skills via the following course: 801-136 English Comp. 1 (ENG 101). The Computational skills requirement needs to be fulfilled by passing the course MATH 111 at UW-P.
Completion of a. A.S. in the Marketing program at Gateway completes the Reading and Writing skills and the Computational skills requirements via the following courses: 801-195 or 801-136 for UW-P ENGL 101 and 804-115 for UW-P MATH 112.

Remedial Action shall not preclude Contributor or the Partnership from asserting a subsequent HSE Remedial Action Claim that arises from the same condition, event, circumstance or other basis that resulted in the original Remedial Action (except with respect to the work completed in such original Remedial Action); PROVIDED, that the Partnership shall be responsible, pursuant to Section 5.2(d), if and to the extent that it exacerbates or accelerates such subsequent HSE Remedial Action Claim as set forth in Section 5.2(c); and PROVIDED, FURTHER, that the Partnership shall be responsible for maintaining compliance with HSE Laws from and after the date on which the correction of any noncompliance with HSE Laws is completed consistent with Section 5.5(g).
