COMPLIANCE OF AGENTS. Business Associate agrees to ensure that any agent, including a subcontractor, to whom it provides Protected Health Information received from, or created or received by Business Associate on behalf of Metro, agrees to the same restrictions and conditions that apply through this Agreement to Business Associate with respect to such information.
COMPLIANCE OF AGENTS. A. Recipient agrees to ensure that any agent, to whom it provides SDI created, received, maintained, transported or transmitted by Recipient on behalf of MNPS, agrees to the same terms of this Agreement.
COMPLIANCE OF AGENTS a. MBPE may designate third parties who are authorized to securely access its SDI in Recipient’s possession/custody. Recipient shall not disclose the SDI to any third party unless MBPE has a current Data Use and Integration Security contract with that third party, Recipient has received prior written approval by MBPE, or such disclosure is required by law.
COMPLIANCE OF AGENTS. A. Recipient agrees to ensure that any agent, to whom it provides SDI created, received, maintained, transported or transmitted by Recipient on behalf of KCS, agrees to the same terms of this Agreement.
COMPLIANCE OF AGENTS. Recipient agrees to ensure that any agent, to whom it provides SDI created, received, maintained, transported or transmitted by Recipient on behalf of MNPS, agrees to the same terms of this Agreement. For all employees or subcontractors who have access to SDI, during the term of each subcontractor or employee’s employment by Recipient, Recipient shall at all times cause such subcontractor or employee to abide strictly by Recipient’s obligations under this Agreement.
COMPLIANCE OF AGENTS a. Recipient agrees to ensure that any agent, to whom it provides SDI created, received, maintained, or transmitted by Recipient on behalf of MBPE, agrees to the same restrictions and conditions that apply through this Contract to Recipient with respect to such information. For all employees or subcontractors who have access to SDI, during the term of each subcontractor or employee’s employment by Recipient, Recipient shall at all times cause such subcontractor or employee to abide strictly by Recipient’s obligations under this Contract. Recipient further agrees that it shall maintain a disciplinary process to address any unauthorized access, use or disclosure of SDI by any of Recipient’s officers, partners, principals, employees, or agents.
COMPLIANCE OF AGENTS. TMIC agrees, in accordance with 45 CFR 164.502(e)(1)(ii) and 164.308(b)(2), to require any Subcontractors that create, receive, maintain, or transmit Protected Health Information on behalf of the Business Associate to agree to the same restrictions, conditions, and requirements that apply to the Business Associate with respect to such information.
COMPLIANCE OF AGENTS. That its agents, including subcontractors that create, receive, maintain or transmit PHI on behalf of Business Associate, are subject to the same restrictions and conditions that apply to Business Associate with respect to the PHI under this Agreement. Business Associate agrees to obtain written business associate agreements with all such agents and subcontractors, to ensure that its agents, including subcontractors, agree to and do comply with the conditions, restrictions, prohibitions and other limitations regarding the request for, creation, receipt, use or disclosure of PHI, that are applicable to Business Associate under this Agreement. Business Associate also agrees to ensure that any agents, including subcontractors, to whom it provides Electronic Protected Health Information agree to implement reasonable and appropriate safeguards to protect it.
COMPLIANCE OF AGENTS. Business Associate agrees to require any agents, including subcontractors, that create, receive, maintain or transmit PHI on its behalf to agree to the same restrictions and conditions that apply to Business Associate through this Agreement with respect to such PHI.
COMPLIANCE OF AGENTS a. The District may designate third parties who are authorized to securely access its Student Record Information in PowerSchool's possession/custody, PowerSchool shall not disclose any Student Record Information to any third party unless PowerSchool has received prior written approval by District or such disclosure is required by law.
