Common use of Compliance with Company Instructions Clause in Contracts

Compliance with Company Instructions. If such suspension or revocation comes as a result of his/her complying with the Company’s instruction, which results in a succession of size and weight penalties or because he/she complied with the Company’s instruction to drive Company equipment which is in violation of DOT regulations, the Company shall provide employment to such employee at not less than his/her regular earnings at the time of such suspension for the entire period thereof. This paragraph shall not apply to an employee who knows that the Company equipment is in violation of DOT regulations before he/she begins his/her run, but fails to notify the Company in writing of the defective equipment. The Company shall be responsible for any citation issued if it occurred through no fault of the driver.
