Common use of COMPTROLLER’S CERTIFICATE Clause in Contracts

COMPTROLLER’S CERTIFICATE. 33.1. This Contract shall not be binding or be of any force or effect unless the Comptroller shall endorse a certificate that there remains an unexpended and unapplied, as provided in Section 6- 101 of the Administrative Code, balance of the appropriation of funds applicable thereto sufficient to pay the estimated expenses of executing this Contract as certified by the officer making the same. This Contract shall continue in force only after annual appropriation of funds by the City and certification as herein above set forth. 34.1. The Contractor is subject to an annual performance evaluation to be conducted by NYCDOT pursuant to the PPB Rules.
