Conclusiveness and Enforcement. The decision of the Negotiating Committee or of the arbitrator, as the case may be, shall be final, binding and conclusive upon all parties (the District Council, Employer and employees and all claiming thereunder) and shall be one method of resolving such disputes, provided, however, that if either party refuses to submit such dispute to arbitration or to abide by the decision of the arbitrator, then either party shall have the right to go into any court for the purpose of enforcing such submission or compliance.
Conclusiveness and Enforcement. The decision of the Joint Trade Board or of the arbitrator, as the case may be, shall be final, binding and conclusive upon the Union, the Employers, the Association, employees and all claiming thereunder and shall be the sole method of resolving such disputes or differences of opinion, provided, however, that if the Employer, the Association, the Union or the employee refuses to abide by the decision of the Joint Trade Board or the Arbitrator, then the Association or the Union, as the case may be, without in any way limiting other remedies available to it, shall have the right to go into any court for the purpose of enforcing such submission or compliance. In the event the Joint Trade Board, the Union or the Association must resort to judicial proceedings for the purpose of enforcing such submission or compliance then the Joint Trade Board, the Union or the Association shall be entitled to recover all costs and expenses (including without limitation, costs and attorneys' fees) incurred by that body for said purpose.
