Common use of Confidentiality of this Agreement and its Terms Clause in Contracts

Confidentiality of this Agreement and its Terms. Except as otherwise provided in this Article 8, each Party agrees not to disclose to any Third Party the existence of this Agreement or the terms of this Agreement without the prior written consent of the other Party hereto, except that each Party may disclose the terms of this Agreement that are not otherwise made public as contemplated by Section 8.5 and as permitted under Section 8.3.

Confidentiality of this Agreement and its Terms. Except as otherwise provided in this Article 86, each Party party agrees not to disclose to any Third Party the existence of this Agreement or the terms of this Agreement without the prior written consent of the other Party party hereto, except that each Party party may disclose the terms of this Agreement that are not otherwise made public as contemplated by Section 8.5 and 6.5 as permitted under Section 8.36.3.

Confidentiality of this Agreement and its Terms. Except as otherwise provided in this Article 811, each Party agrees not to disclose to any Third Party the existence of this Agreement or the terms of this Agreement without the prior written consent of the other Party hereto, except that each Party may disclose which Agreement and terms shall be deemed the terms Confidential Information of this Agreement that are not otherwise made public as contemplated by Section 8.5 and as permitted under Section 8.3both Parties.

Except as otherwise provided in this Article 810, each Party party agrees not to disclose to any Third Party the existence of this Agreement or the terms of this Agreement without the prior written consent of the other Party party hereto, except that each Party party may disclose the terms of this Agreement that are not otherwise made public as contemplated by Section 8.5 and 10.6 as permitted under Section 8.310.4.

Except as otherwise provided in this Article 89, each Party party agrees not to disclose to any Third Party the existence of this Agreement or the terms of this Agreement without the prior written consent of the other Party party hereto, except that each Party party may disclose the terms of this Agreement that are not otherwise made public as contemplated by Section 8.5 and 9.5 as permitted under Section 8.39.3.

Confidentiality of this Agreement and its Terms. Except as otherwise provided in this Article 8, 11 each Party agrees not to disclose to any Third Party the existence of this Agreement or the terms of this Agreement without the prior written consent of the other Party hereto, except that each Party may disclose which Agreement and terms shall be deemed the terms Confidential Information of this Agreement that are not otherwise made public as contemplated by Section 8.5 and as permitted under Section 8.3both Parties.

Except as otherwise provided in this Article 8, each Each Party agrees not to disclose to any Third Party the existence of this Agreement or the terms of this Agreement without the prior written consent of the other Party hereto, except that each Party may disclose the terms of this Agreement that are not otherwise hereto other than those made public as contemplated by Section 8.5 12.6 except to its legal or financial advisors or potential investors, acquirers, licensees, partners or collaborators who are bound by written confidentiality and as permitted under Section 8.3non-use obligations no less stringent than those contained in this Article 12.

Except as otherwise provided in this Article 8Section 11.6, each Party agrees not to disclose to any Third Party the existence of this Agreement or the terms of this Agreement without the prior written consent of the other Party hereto, except that each Party may disclose the terms of this Agreement that are not otherwise made public as contemplated by Section 8.5 Agreement: (a) to advisors (including financial advisors, attorneys and as permitted accountants) in each case under Section 8.3confidentiality obligations substantially equivalent to those in this Agreement; or (b) actual or potential acquisition or merger partners or Sublicensees on a need to know basis, in each case under written confidentiality agreements substantially equivalent to those in this Agreement.

Except as otherwise provided in this Article 85, each Party agrees not to disclose to any Third Party third party the existence of this Agreement or the terms and conditions of this Agreement without the prior written consent of the other Party heretoParty, except that each Party may disclose the terms and conditions of this Agreement that are not otherwise made public as contemplated by Section 8.5 and 5.5 as permitted under Section 8.35.3.
